Jakarta is No Longer The Capital of Indonesia



JakartaHerald.com - Jakarta has lost its status as the capital city of the Republic of Indonesia since February 15, 2024. 

This change was a result of the implementation of Law No. 3/2022 concerning the State Capital City (IKN). The IKN policy stipulates that two years after its enactment, Law No. 29/2007 regarding the Special Capital Region of Jakarta (DKI) will no longer be in effect.

"At the latest 2 [two] years after this Law is enacted, Law No. 29 of 2007 regarding the Regional Government of the Special Capital City of Jakarta as the Capital of the Unitary State of the Republic of Indonesia shall be amended in accordance with the provisions under this Law," as stated in Article 41 paragraph (2) of the IKN Law, quoted by Jakarta Herald on Wednesday (6/3/2024).

The following paragraph explains that the changes to the law will take effect once the President officially issues a Presidential Decree (Keppres) regarding the relocation of the capital from Jakarta to Nusantara, East Kalimantan.

Once the President's decision is made, as per Article 41 paragraph (1) of the IKN Law, Law No. 29/2007 will be repealed and declared invalid, except for its functions as an autonomous region. 

The regulation of Jakarta as a region with special authority will be governed by separate legislation. This aligns with Article 41 paragraph (4) of the IKN Law, which states, "The changes to the law as referred to in paragraph (2) shall govern the specificity of Jakarta..

Accelerates Drafting of RUU DKJ Meanwhile, the Indonesian House of Representatives (DPR RI) is expediting the deliberation of the Draft Law on the Special Region of Jakarta (RUU DKJ) as a consequence of the capital relocation to Nusantara. 

The 13th Plenary Session of the IV Session of the 2023-2024 Parliamentary Term has officially approved that the Legislative Body (Baleg) of the DPR RI will discuss the RUU DKJ. 

Baleg Chairman Supratman Andi Agtas stated that within the next 1-2 days, they will promptly hold a Working Meeting with the Minister of Home Affairs, considering the loss of DKI's status in Jakarta since February 15. 

"The RUU DKI lost its status on February 15th, it's the implication of the IKN Law, the two-year period ended on February 15th. Now DKI has no status. That's why we need to expedite [the deliberation of the RUU DKJ]," said Supratman at the Nusantara II Building of the DPR RI, Senayan, Jakarta, on Tuesday (5/3/2024). 

Furthermore, the Gerindra Party politician explained that the discussion of the draft RUU DKJ with the Minister of Home Affairs will redefine the special status of Jakarta. 

However, Jakarta will no longer be discussed in its capacity as the national capital, but its new status will be deliberated with the government. "

So, thoughts on that specificity will give rise to ideas regarding Article 10, as it is a special region. One of the points besides being a special region for businesses, economy, trade center, financial center, and others," emphasized Supratman.
